§ 66-35. Permits.

  • (a)

    All persons and entities engaging in the business of refuse collection or disposition within the city shall possess a permit from the city whose designate shall issue such permit only to persons and entities who make written application and who exhibit the following:

    (1)

    Have proper equipment including proper vehicles and refuse containers if such are provided to customers, and personnel to collect and dispose of refuse in accordance with this article.

    (2)

    Use a method of disposal in accords with the provisions of this article, the regulations promulgated under this article, and the laws of the state, or the state in which collected materials are disposed, and the federal government.

    (3)

    Provide to public works director, or his designate, the full name and residence or business address of the permit applicant, the manufacturer's name, model, make, year and state license number of each vehicle owned by or leased to the applicant for the purpose of refuse disposal or collection in the city.

    (4)

    Have printed the name of the person or entity on the equipment used in the collection or disposal of refuse in letters at least three inches tall.

    (5)

    Submit documentation signed by the person or representative of the entity applying for the permit verifying that the equipment to be used by the permit applicant for the collection and disposition of refuse is acceptable for the purpose for which it is intended.

    (6)

    Submit information advising as to the location wherein collected materials are to be deposited.

    (7)

    Submit certificate of insurance with the City of Niles as a named insured in aggregate coverage for all losses of $1,000,000.00.

    (8)

    Submit a certificate of insurance demonstrating compliance with the Worker's Disability Compensation Act of 1919 (MCL 418.101 et seq.) if and as required by law.

    (9)

    Offer to all customers not less than monthly recycling services which shall include curbside pick-up of recyclable materials and which service shall be voluntary for the customers.

    (10)

    Submit copies of all printed material to be provided to customers advising that recycling is available, which printed material shall include the details and procedures of collection of recyclable materials for that customer.

    (b)

    The public works director shall draft the certificate required of permit applicants in subsection (a)(5) of this section.

    (c)

    Fees for the issuance of permits and approval stickers provided for in this article shall be set by the resolution of the city council from time to time.

    (d)

    Permits issued under this article shall be valid until the first Monday of June following issuance, and shall be renewable thereafter for one year terms. Permits issued under this article shall be nontransferable.

    (e)

    With the issuance of the permit described in this article, the public works director shall also issue a sticker which shall be prominently displayed in the lower right corner (passenger side) of the windshield of each vehicle to be operated by the person or entity to whom the permit is issued.
